Where to register the brand

In Mexico, the entity responsible for protecting, through the granting of property titles, trademarks, patents, copyrights, among others, is the Institute of Intellectual Property (IMPI) for its initials in Spanish.

The IMPI offers support with some facilities and makes the corresponding online forms available for trademark registration. It also offers an online registration option, thus avoiding the need to visit its offices.

How to start the registration

These are some simple steps to register your brand:

1. Define your brand. Once it is defined, you must perform a search in MARCANET.

By doing this search, you'll be able to find out if it's already registered or if there's one similar to yours.

2. After the search, you must fill out the form Application for Protection of Distinctive Signs, which can also be download from the IMPE Website.

If you have already applied for registration in another country and want the foreign legal date recognized, you have six months to apply to the IMPI.

3. Pay the cost for the study of a national application, for the Brand Registration until the completion of the process or the issuance of the title, which is around $2,852 MXN back in 2020.

4. Have additional documentation, official identification of the person carrying out the procedure; if they are the company's legal representative, they must have their respective power of attorney, among others.

Options for completing the paperwork

The IMPI has the following options for trademark registration:
Onsite Registration Paperwork

1. Fill out the application.
2. Add the corresponding attachments.
3. Make the payment at the bank teller or by electronic transfer.
4. Go to the authorized offices to receive applications and promotions.
5. Submit the application and its attachments.
6. Keep your receipt.
7. Check MARCANET periodically to check the status of your file.
8. Wait for the Institute's response. You can be notified at the address you provide or through the Industrial Property Gazette.

Online:

1. Obtain your FIEL as an individual.
2. Get a registration for a username and password.
3. Fill the application.
4. Attach the corresponding attachments in PDF format.
5. Make the payment at the bank teller or by electronic transfer.
6. Sign in using your FIEL.
7. Download the electronic acknowledgment.
Check MARCANET periodically to see the status of your application.
9. Wait for the Institute's response, as you may be notified through your electronic dashboard.

Postal mail or specialized courier:

1. Fill out the application.
2. Attach the necessary attachments.
3. Make the payment at the bank teller or by electronic transfer.
4. Go to the post office or specialized parcel service closest to your home.
5. Send the application and its attachments.
6. Keep your tacking number or acknowledgment of receipt.
7. Check MARCANET periodically to see the status of your application.
8. Wait for the Institute's response. You can be notified at the address you provide or through the Industrial Property Gazette.
